1. Acceptance of Terms

By accessing or using Petal Technology's website and Metrics software ("Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Services.

2. Description of Services

Petal Technology provides Metrics, a software application for streaming and recording EEG and biometric data from Muse headsets. Our Services include the desktop application, cloud features (where applicable), and related support.

3. Account Registration

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. Subscription and Payment

Paid features require a subscription. By subscribing, you authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time, and it will remain active until the end of your current billing period.

5. Acceptable Use

You agree not to:

  • Use the Services for any illegal purpose
  • Reverse engineer, decompile, or disassemble the software
  • Share your account credentials with others
  • Attempt to gain unauthorized access to our systems
  • Use the Services to harm others or violate their privacy

6. Intellectual Property

Metrics and all related content, including but not limited to software, designs, logos, and documentation, are the intellectual property of Petal Technology LLC. You are granted a limited, non-exclusive license to use the software for its intended purpose.

7. Data Ownership

You retain ownership of all data you record or generate using Metrics. We do not claim any ownership rights to your EEG data or recordings.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PETAL TECHNOLOGY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

10. Medical Disclaimer

Metrics is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The EEG data provided is for informational and research purposes only.

11. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of significant changes by email or through the Services. Continued use after changes constitutes acceptance of the new terms.
